JAIRA SIA, REG. NO. 40203613607, ADDRESS Rīgas gatve 88, Ādaži, LV-2164, Latvia, hereinafter – the online store – provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General Provisions

If a consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including but not limited to the “Consumer Rights Protection Law of the Republic of Latvia,” the Cabinet of Ministers Regulations “Regulations on Distance Contracts,” etc.

2. Making Purchases

The prices and specifications of the products sold in the online store are indicated next to the products.
To place an order, add the desired products to the shopping cart. Fill in all required fields and choose the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete the purchase by making the payment.

3. Payment Terms

The payment currency on the website is Euro. Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

  • Visa/Mastercard card payments

NB! When using the internet banking payment method, confirm the order and click the button “Return to merchant.”
The personal data required for making payments is transferred to the licensed payment institution Maksekeskus AS.
The contract comes into force upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered to the following countries: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Estonia, Ireland, Greece, Spain, Italy, Cyprus, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Finland, Hungary, Germany, Sweden, Croatia, France.
Purchased goods are delivered via DBD and OMNIVA. All duties and taxes payable to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before confirming the order. Purchased goods are delivered to the address indicated by the Buyer within 2–10 business days. In exceptional cases, we reserve the right to dispatch goods within up to 45 calendar days, notifying the customer.

5. Right of Withdrawal

The Buyer has the right to withdraw from the product within 14 calendar days from the moment of receiving the product. (Depending on the product, the Buyer may not have a mandatory right of withdrawal; in such cases, the reason must be clearly indicated and explained). The right of withdrawal does not apply if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, products may only be used for their intended purpose; the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the products are improperly used, damaged, negligently handled, used contrary to the instructions, the original packaging is lost, or the packaging is significantly damaged, the online store has the right to reduce the refundable amount in proportion to the decrease in the product’s value.

To exercise your right of withdrawal and return the product, you must contact the online store within 14 days of receiving the product by sending a notification to the e-mail address management@jaira.eu. After receiving the notification, you will be provided with information about the further procedure for returning the product.

The following sentence is intended for online stores unable to offer free returns: The Buyer covers the cost of returning the goods, except in cases where the return is due to the item not matching the order (e.g., incorrect or defective product).

The Buyer must return the goods to the Seller without undue delay, but no later than 14 days after sending the withdrawal form to the online store. Upon receiving the returned goods, the online store will immediately, but no later than within 14 days, refund all payments received from the Buyer under the Distance Contract.

The Seller has the right to withhold the refund until the goods are received from the Buyer or proof of return is provided. If the Buyer has chosen a delivery method other than the cheapest one offered by the online store, the online store is not obliged to reimburse the additional delivery costs.

The online store is not responsible for delays or failures in performance due to circumstances beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell goods and to request the return of goods from the Buyer if the price indicated in the online store is significantly lower than the market price due to an error.

6. Consumer Rights Regarding Non-Conforming Goods

The online store is responsible for non-conformity or defects in the goods sold to the Buyer that appear within 6 months from the date of delivery to the customer, or that existed at the time of delivery, unless such assumption is inconsistent with the nature of the item or the defect. The Buyer must inform the Seller of the non-conformity immediately, within 2 months of discovering it, i.e., by submitting a complaint. The Buyer can submit a complaint by contacting the online store via management@jaira.eu.

The online store is not responsible for defects that occur after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request that the defects be remedied or that the goods be replaced with new goods free of charge.

If the goods cannot be repaired or replaced, the Seller will refund all payments provided for in the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.

7. Processing of Buyer’s Personal Data

The online store processes only the personal data entered by the Buyer when placing an order, such as name, surname, email, etc.
The online store transfers personal data to transport service providers to ensure delivery of the goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may occasionally contact you with information about our services and latest offers. For this purpose, we may process your email address provided during subscription to marketing communication. The Buyer has the right to unsubscribe from marketing communications by notifying us at management@jaira.eu.

8. Dispute Resolution

For matters not covered by these Terms and Conditions, the Buyer and Seller undertake to comply with the laws of the Republic of Latvia.
All disputes arising between the Seller and the Buyer shall be resolved through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve the dispute in the courts of the Republic of Latvia, in accordance with Latvian legislation. Disputes between the Buyer (consumer) and the Seller may also be referred to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
The Buyer also has the right to apply to the European Union dispute resolution institutions.
